Delivery Fee

A fee of $1.25 per mile is quoted from our warehouse in San Leandro to the delivery location.

 

Damage Wavier

A 10% fee is automatically applied to linens, glassware, flatware, and dishware.

 

Labor

20% of rental total.

 

Policies & Agreements

In consideration of renting specified items from Joe Squared Productions (“Joe Squared Productions” and referred to as “we” or “our”), you agree to abide by our following policy and to the contractual terms herein (the “Agreement”). You understand that failure to follow the policy or the terms herein, or otherwise damaging or losing any rental item, will result in additional charges to you, which you agree to pay promptly.

Rates: Rates are based on a one-day rental. Weekends are one day, provided the rentals are only used for one event. When your reservation is made, you must pay a 50% non-refundable Deposit of the rental amount. You are required to make full payment 14 days before the event.

We do not reserve items until payment has been received; we must have a signed contract on file, or we are under no obligation to you.

Terms: We must have a signed reservation and 50% payment at the time of reservation. If either item is not in place, your order will remain a quote, not a reservation, and we are under no obligation to you.

Cancellation Policy: If your reservation is canceled before the 14-day window of the event, 50% of the total rental will be withheld from your initial payment. A 75% fee will be collected if canceled within 14 days before the event. 100% of the fee will be kept if canceled within 48 hours before the event date.

Delivery/Pickup & Set-Up: Arrival times are estimates only. Joe Squared Productions will not refund delivery fees if we are late. You may call our office to get a better idea of the arrival time on the delivery day. Additional delivery charges will apply for orders requiring delivery/pickup at specific times. We cannot guarantee a specific delivery/pickup time without additional charges. To find out when your order is scheduled for delivery/pickup, please call the day of the delivery/pick-up date indicated on your contract. We will approximate the time frame if deliveries/pickups go as planned. All delivered equipment is dropped off in stacks, as close to your requested area as possible with our delivery vehicle; we need to be able to access the drop-off/pick-up area within 75 feet of the truck. We require a hard surface to roll equipment. If items must be transported to a specific area, i.e. (Inside buildings, upstairs, elevators, etc.), please advise our staff ahead of time. Additional fees will apply if delivery is a long distance and equipment must go upstairs or in an elevator.

If you set up the equipment, you must break it down and return it to where it was delivered. If equipment is not ready for pick up, an hourly fee will be charged for standby time or breakdown/carrying. All items being picked up must be in the exact location as we delivered them.

Heaters: Heaters can be complicated to light in some conditions. Heavy winds and rain are not ideal for heaters, and Joe Squared Productions is not responsible if heaters do not light in these conditions. Heaters should be on a level surface. Joe Squared Productions will set up and test heaters on-site when delivered. Sometimes, we may leave the pilot light(s) on for easy on/off usage. We always recommend turning on heaters 1-2 hours before your event. If you cannot get heaters working and conditions are reasonable, call our emergency phone number, 925-580-9059, and talk to someone or leave a message. Refunds will not apply if a timely call is not made and a clear message is left.

Carpets: Carpets are meant for indoor use and must be installed on dry surfaces only. They will be taped down with double-sided tape. Joe Squared Productions will not be responsible for any damage to the floors. You understand that residue may be left from taping. All the carpets must be returned in the same condition as when we brought them to you.

Linens: As a service to our customers, we rent top-quality linens and napkins in various colors and sizes. Do not place linens in plastic bags wet; doing so may cause molding and damage the linens. Linen bags will be provided in most situations. When picking up linens, you must verify that you received the appropriate quantity. Upon returning to us, all linens must be free from burns, tears, pins, tacks, abrasions, etc. You are responsible for the replacement cost of any missing or damaged items. Shake out loose debris from linens (food, petals, decorations, etc.). Failure to remove all loose debris will result in a fee. We reserve the right to make a final inspection of linens when performing our sorting process. Typically, this process will be done within 48 hours, after which you will be notified of missing or damaged items.

Staging & Flooring: When choosing a stage or dance floor location, the most level area should be selected. Our wood parquet dance floor is for indoor or outdoor use with a subfloor. If used outside and damage occurs, you are liable for repair and/or replacement of the dance floor. You are responsible for protecting the stage or dance floor from weather, water, dampness, etc. Charges will apply for any damage.

Inspection of Rented Items: You rent the items on an “as is” basis and agree to inspect them personally before using them. Unless otherwise notified before the event, you acknowledge that all rental items were delivered in good working order and repair and that you understand, without further instruction, the proper operation and use of every rental item.

Assumption of Risk: You agree that you fully understand the risk of injury or damage arising from using or operating the rental items. You voluntarily assume all the risk of injury or damage associated with operating and using the rental items. You further agree to release and discharge Joe Squared Productions, including its officers, directors, employees, and contractors, from all responsibility or liability from such injury or damage arising out of the operation or use of the rental items and to waive, release and discharge all claims for injury or damage against Joe Squared productions, including its officers, directors, employees and contractors, which you otherwise may be entitled to assert; except for those solely caused by the gross negligence or willful misconduct of Joe Squared productions.

Indemnity: You agree to take all necessary precautions regarding the rental items, to use the rental items correctly and as intended, and to protect all persons and property from injury or damage. You also agree to hold Joe Squared Productions, including its officers, directors, employees, and contractors, harmless from and against any liability, claims, judgments, attorneys’ fees, and costs of every kind and nature, including but not limited to, injuries or death to persons and property damage, arising out of the use, maintenance, operation, possession or rental of the items rented, however caused, except to the extent arising through the sole gross negligence or willful misconduct of Joe Squared Productions.

Amendments: No change, modification, or addition to the terms and conditions contained herein will be valid unless it is outlined in writing and signed by both parties.

Attorney’s Fees: If any legal action is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party will be entitled to recover reasonable attorneys’ fees and other costs incurred in that action, in addition to any other relief to which they may be entitled.

Governing Law: This Agreement will be construed and enforced in accordance with the laws of the State of California without giving effect to its principles of conflicts of law.
